SBH Attorneys Jenny Blake and Lauren Scalzo successfully defended a family physician against claims he negligently caused the perforation of his patient’s eardrum during an irrigation to remove earwax. The seventy-year-old patient alleged that as a result of the perforation of his tympanic membrane during or immediately after the irrigation procedure, he experienced permanent and disabling tinnitus and hearing loss. Attorneys Blake and Scalzo argued the physician had acted with appropriate care and the perforation was an unforeseeable complication. The plaintiff asked the jury to award approximately $1.3 million in damages. The jury returned a decisive verdict in favor of the physician. The case was tried in the Circuit Court of Cook County before Judge Bridget Hughes.
