Circuit Court grants motion to transfer case out of Cook County based on the doctrine of intrastate

Jenny Blake and Joseph Rourke won a motion to transfer a medical malpractice case filed in the Circuit Court of Cook County to Lake County under the doctrine of intrastate forum non conveniens. Blake and Rourke argued that, despite Cook County being the Plaintiff’s county of residence and chosen forum, a balancing of the applicable private and public interest factors strongly favored transferring the case to Lake County because all of the at-issue care and treatment occurred at a Lake County facility.
