SBH attorneys Jenny Blake and Kim Flanigan successfully defended a local hospital for the conduct of a neurosurgeon and trauma surgeon against claims arising from the care and treatment related to a 42-year-old man’s subdural hemorrhage and subsequent death. Plaintiff alleged the patient was improperly cleared by neurosurgery and improperly discharged home by the trauma service. Plaintiff further alleged that as a result of the negligent discharge, the patient suffered a massive expansion of his subdural hemorrhage roughly 12 hours later which lead to his severe brain damage and death 4.5 years later. Plaintiff asked the jury to award damages in the range of $21.5 to $23.5 million. The jury returned a verdict in favor of the hospital and the doctors in roughly two hours. The case was tried in the Circuit Court of Cook County before Judge Elizabeth Budzinski.
