SBH Attorneys Mark Smith, Greta Powell, and Katie Vaughan successfully defended a local hospital, two Maternal Fetal Medicine Specialists, an OB/GYN, and two nurses at trial for their treatment of a forty-four-year-old woman who was 32 weeks pregnant at the time of treatment. Plaintiff claimed the medical providers failed to properly treat the patient in the setting of a possible diagnosis of pre-eclampsia, resulting in the mother developing eclampsia/HELLP syndrome and suffering a stroke and the baby being born prematurely and having resultant injuries. SBH attorneys argued the patient was not preeclamptic when she was seen by the medical providers and that there was no indication to keep her hospitalized for monitoring and observation. They further argued neither the mother’s nor the baby’s injuries were severe. Plaintiff asked the jury to award in excess of $5.5 million. After approximately two hours of deliberations, the jury returned a verdict in favor of all defendants. The case was tried in the Circuit Court of Cook County before Judge Janet Adams Brosnahan.
